These Terms of Service ("Terms") govern access to and use of Izwi, an AI voice receptionist service that answers business phone calls, books appointments, takes messages, and handles common questions on behalf of the business that configures it (the "Service"). By creating an account or using the Service you agree to these Terms.

1. The Service

Izwi connects a phone number to an AI assistant configured by you (a "voice agent"), handles inbound calls using that configuration, and can log call metadata, transcripts, and — where you enable it — recordings; escalate to a human team member based on rules you set; and create calendar events through a Google or Microsoft calendar connection you authorize. The Service depends on third-party telephony, AI, and calendar providers and its availability and accuracy is not guaranteed to be uninterrupted or error-free.

2. Accounts and subscriptions

You must provide accurate account information and are responsible for activity under your account, including actions taken by team members you invite. Subscriptions are billed on a recurring basis through Payfast (our primary payment processor for South African customers) or Stripe, where offered. Payment is tokenized: your card details are captured and processed directly by Payfast or Stripe on their own PCI-DSS-certified infrastructure, and Izwi never receives or stores your raw card number, CVV, or expiry date — only a payment token used to process recurring charges.

You can cancel a subscription at any time from your billing settings; cancellation takes effect per the terms shown at checkout/in-app at the time of cancellation. Fees already charged are non-refundable except where required by law.

3. Acceptable use

You are responsible for the content of the voice agents you configure, including any forbidden-topic and escalation rules. You agree not to configure the Service to:

  • Impersonate a person or entity in a misleading or fraudulent way;
  • Collect sensitive personal information from callers beyond what is reasonably needed to provide your stated service;
  • Break applicable law, including telemarketing, consumer protection, and data protection law in the jurisdictions where you operate; or
  • Circumvent the Service's built-in guardrails, such as disabling caller notice when call recording is enabled for a script.

Where you enable recording on a voice agent, the Service instructs the AI assistant to inform callers that the call may be recorded for quality purposes; you are responsible for ensuring this is sufficient for the consent requirements that apply to your business and jurisdiction.

4. Your data and callers' data

As between you and Izwi, you retain ownership of the business data, call transcripts, and recordings generated through your use of the Service, subject to the license you grant us to process it in order to provide the Service. You are responsible for having a lawful basis to have Izwi handle calls on your behalf and to inform your callers accordingly, including via your own privacy notice. Our Privacy Policy describes how we process this data, our subprocessors, and the data export and deletion-request tools available to tenant owners and admins.

5. Service changes and beta features

Izwi is currently offered in public beta. Features, pricing, and promotional offers (such as beta discount codes) may change, and features may be added, modified, or removed as the product evolves. We will make reasonable efforts to communicate material changes that affect paying tenants.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IZWI AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

8. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access to the Service if you materially breach these Terms (including the acceptable use provisions in Section 3), fail to pay applicable fees, or if required to do so by law. On termination, your right to use the Service ends; data handling on termination is governed by our Privacy Policy, including the manual, reviewed data-deletion-request process described there.

9. Governing law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles, unless mandatory local law in your jurisdiction requires otherwise.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date on this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
